Terms of Use

1. Acceptance of terms

These Terms of Use ("Terms") govern your access to and use of the Impact Saathi platform, website, and related services (collectively, the "Service"), operated by G Systems ("G Systems," "we," "us," or "our"). By creating an account, subscribing to a plan, making a donation, or otherwise using the Service, you agree to be bound by these Terms.

If you are entering into these Terms on behalf of an organisation — such as an NGO or a corporate CSR team — you represent that you have authority to bind that organisation, and "you" refers to both you and that organisation.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding contract under Indian law to use the Service. NGO accounts may only be created by individuals authorised to represent a legally registered nonprofit organisation.

3. Account registration

To access certain features, you must register for an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@impactsaathi.com if you suspect unauthorized use of your account.

4. Subscriptions & billing

Impact Saathi offers paid subscription plans, including the NGO Growth plan and the Corporate Enterprise plan, each described on our Pricing page. By subscribing, you agree to the following:

  • New subscriptions on listed launch plans include a free trial period of 3 months from the date of signup, during which no payment is collected.
  • Unless you cancel before the trial period ends, your subscription will automatically convert to a paid plan and billing will begin at the then-current listed price for your selected plan and billing cycle.
  • Subscription fees are billed in advance, either monthly or annually, depending on the billing cycle you select at signup.
  • All fees are quoted in Indian Rupees (INR) and are exclusive of applicable taxes (such as GST), which will be added at checkout where applicable.
  • Online payments are processed through a third-party payment gateway. We do not store your full payment card details.
  • You may cancel your subscription at any time through your account settings or by writing to us; cancellation takes effect as described in our Refund & Cancellation Policy.

5. Donation processing

Impact Saathi enables NGOs to receive donations from donors through the Platform. G Systems is a technology service provider and is not a party to the donation transaction between a donor and an NGO. Specifically:

  • NGOs are solely responsible for the accuracy of their registration, 12A, 80G, and FCRA certification details provided on the Platform.
  • 80G tax receipts are generated using the information the NGO has provided; G Systems is not responsible for inaccuracies arising from incorrect NGO-supplied data.
  • Donations made through the Platform are generally non-refundable except as required by applicable law or as agreed directly between the donor and the receiving NGO.
  • G Systems does not take custody of donated funds; funds are settled directly from the payment gateway to the NGO's designated bank account.

6. NGO obligations

NGOs using the Platform agree to:

  • Maintain valid and current 12A and 80G registration where claiming tax-exempt donation status
  • Provide accurate organisational, banking, and certification information
  • Use fund-utilization update features to communicate honestly and accurately with donors
  • Comply with the Foreign Contribution (Regulation) Act, 2010 (FCRA) where accepting foreign donations
  • Promptly update certificate information on the Platform upon renewal or change

7. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Misrepresent your identity, organisation, or NGO registration status
  • Attempt to gain unauthorized access to the Platform, other users' accounts, or our systems
  • Upload malicious code, interfere with the Platform's operation, or attempt to reverse-engineer the Service
  • Use the donation widget or campaign tools to solicit funds for a cause materially different from what is represented to donors

8. Intellectual property

The Impact Saathi name, logo, platform design, and underlying software are the property of G Systems and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without our prior written consent.

Content you upload (such as NGO profile information, campaign descriptions, or fund-utilization updates) remains your property, but you grant G Systems a license to host, display, and transmit that content as necessary to operate the Service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

10. Limitation of liability

To the maximum extent permitted by applicable law, G Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of or inability to use the Service. Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you paid us in subscription fees in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service if you breach these Terms, including by providing false NGO registration information or misusing donor funds. You may terminate your account at any time by contacting us. Upon termination, certain records — such as donation and receipt history — will be retained as required for legal and audit compliance.

12. Governing law

These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Gautam Buddha Nagar, Uttar Pradesh, India.

13. Changes to these terms

We may revise these Terms from time to time. We will post the updated Terms on this page with a revised "Last updated" date and, for material changes, notify registered users by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
